Charlestown Fire District Charter
Section 4. The qualified taxable inhabitants of said Charlestown fire district at each
annual meeting and at any other meeting when vacancies occur, shall elect a board consisting of five (5) engineers. All five (5) engineers shall serve two-year terms, which terms shall be
staggered. The board of engineers shall be responsible for the care, management, and control of all property and equipment owned by the district which is used for the prevention or
extinguishment of fires.
Bylaws of the Charlestown Fire District
Section 3. Board of Engineers
3.1 The members of the Board of Engineers shall be qualified electors living within the
Charlestown Fire District. Three of the members shall have a minimum of five (5) years'
experience as a member of an organized fire department. The fourth and fifth members shall not be required to have such experience.
The Board of Engineers shall:
(a) Be responsible for the purchase, care, management, and control of all property and
equipment owned by the Fire District.
(b) Hold and attend a regular monthly meeting of the Board.
(c) Determine the time and place of its regular meetings and post appropriate meeting
notices in accordance with open meetings laws.
(d) Prepare and present the annual budget.
(e) Approve all expenditures of the Fire District.
(f) Have approval authority on all applications for membership forwarded from the
Fire Companies.
(g) Develop and enforce rules and regulations governing members, equipment, and
property of the Fire District.
(h) Appoint committees as deemed necessary by the Board to assist in carrying out
the responsibilities of the Board and in protecting the inhabitants and property of
the Fire District.
(i) Enter into mutual aid or other agreements in order to insure the prompt and
efficient extinguishment of fires within the Fire District.
(j) At the next regular meeting following the Annual Meeting, elect a Chairman and a Vice Chairman. The Chairman shall preside at meetings of the Board. The Vice Chairman shall perform the duties of the Chairman in the absence of the Chairman.
(k) Appoint all district officers and temporary positions as required.
(l) Appoint Assistant Fire Chief(s) to assist in protecting the inhabitants and property
of the Fire District, for such term or terms as the Board in its discretion deems in
the best interest of the Fire District.
3.2 A quorum shall consist of a majority of the members of the Board, and an affirmative vote of a majority of Board members present shall decide any issue.
3.3 Any Board member who fails to attend a minimum of two-thirds (2/3) of the meetings of the Board held during the period of August 1st of any year through July 1st of the next calendar year may be removed, and the unexpired term of such Board member shall be filled in accordance with Section 3.4. Under state and federal emergency conditions, the board may waive the 2/3 rule and fill the position on a temporary basis.
3.4 Any vacancies in the membership of the Board may, at the discretion of the Board, be filled for the unexpired term; except that if the vacancy in the Board shall occur more than one (1) year prior to the time for holding an election for the vacant Board position, the position shall be filled as follows: (a) if the vacancy occurs within the calendar month preceding the month of the annual meeting, the unexpired term shall be filled by election at the annual meeting; (b) if the vacancy occurs prior to the calendar month preceding the month of the annual meeting, the Board shall, within thirty (30) days after the vacancy occurs, call a special meeting for the purpose of an election to fill the vacancy.
